Terms of service

Last updated 22 October 2026

These terms are the agreement between you and James O'Brien, a sole trader in New South Wales, Australia, trading as MBS Scribe ("we", "us", "our"), for using the MBS Scribe service and website. Please read them before you sign up. By creating an account or paying for a plan, you agree to them.

"You" means the doctor who uses MBS Scribe and, where a practice signs up, the practice as well.

1. What MBS Scribe does

MBS Scribe records a telehealth consult, or takes a note you paste in, drafts the consult note, and checks the note against the Medicare Benefits Schedule (MBS). For each item it shows whether the note supports it and the sentence behind that result. You decide what to claim.

MBS Scribe does not:

MBS Scribe is designed not to add anything to the note that was not said or written, but drafts can contain errors.

2. Your clinical and claiming responsibility

You remain responsible for:

MBS Scribe's check is an aid, not a guarantee. Medicare may reject, reduce or recover a claim, and a claim may be reviewed or audited, whatever MBS Scribe showed. We do not promise that any claim will be paid or will survive review.

Recording a conversation without consent is a criminal offence in several states and territories, and on a telehealth call the law where the patient is may also apply. Before you record any consult, you must:

You must also comply with the privacy, health records and surveillance or listening devices laws that apply to you and your patients, and tell your patients how their information is handled. You can point them to our privacy policy.

4. Who can use MBS Scribe

MBS Scribe is for medical practitioners registered with the Australian Health Practitioner Regulation Agency (Ahpra) who practise in Australia, and for practices that employ or engage them. Practice staff may use a doctor's workspace only on that doctor's behalf.

5. Your account

6. Plans and prices

All prices are in Australian dollars and include GST.

Recorded hours reset at the start of each monthly billing period and do not carry over. If you reach your allowance, recording pauses until it resets, and you can still check pasted notes. You can move to a larger plan at any time.

Founding GP offer: the first 100 doctors who take the GP plan yearly can use the code FOUNDINGGP for A$290 off their first year, making it A$200. It applies to a first purchase only, and only to the GP plan.

We may change prices or allowances. We will email you at least 30 days before a change affects you, and it will apply from your next renewal after that notice. If you do not agree, you can cancel before then.

7. Billing and renewal

8. Changing plans, cancelling and refunds

9. Acceptable use

You must not:

10. Your content and privacy

Recordings, transcripts and notes you create in MBS Scribe ("your content") belong to you or your practice. You give us permission to store and process your content only to provide MBS Scribe to you, to keep it secure, to meet our legal obligations, and to create de-identified, combined statistics that cannot identify any GP or patient. We do not use your content to train AI models.

We handle personal and health information as set out in our privacy policy, which forms part of these terms. You can export or delete your content while your account is open.

11. MBS information

MBS Scribe uses information published on MBS Online by the Australian Government Department of Health, Disability and Ageing. We summarise item requirements in our own words and link to the official source. The official MBS on MBS Online is the authoritative version. The MBS changes regularly, and there can be a short delay before a change appears in MBS Scribe.

MBS Scribe is not affiliated with, or endorsed by, the Australian Government, Services Australia, Medicare or the Department of Health, Disability and Ageing.

12. Availability and changes

We work to keep MBS Scribe available and reliable, but it may sometimes be unavailable, for example during maintenance or because of problems with our providers. We may improve or change features over time. If we remove a feature you rely on, we will tell you in advance where we reasonably can, and you may cancel. If you cancel because of that during a yearly plan, we will refund the unused part of that plan.

13. Suspension and ending these terms

14. Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded, restricted or changed.

Where the law allows, and the services are not of a kind ordinarily acquired for personal, domestic or household use, our liability for failing to meet a consumer guarantee is limited to supplying the services again or paying the cost of having them supplied again.

15. Limits on liability

To the extent the law allows:

These limits do not apply to loss caused by our fraud or wilful misconduct. Nothing in these terms limits our obligations under the Privacy Act 1988 (Cth).

16. Changes to these terms

We may update these terms. We will post the new version here with a new date, and email you at least 30 days before any change that reduces your rights takes effect. If you do not agree, you can cancel before the change applies, and if you have a yearly plan we will refund its unused part.

17. Governing law

These terms are governed by the law of New South Wales, Australia, and the courts of New South Wales and the Commonwealth have jurisdiction.
